SHIPPING
1. 21 Years of Age or Older & In Person Signature Requirement: Deliveries require a signature of an individual 21 years of age or older.
2. Missed Deliveries: We understand that you may not always be at home waiting for your wines to arrive! After 3 attempts to deliver, shipments are returned. We hope this does not happen as we provide advance notice that your wine is coming, and tracking numbers will be provided for shipments.
3. Returned Packages: A returned package fee as well as reshipping fee may be charged to you, the customer, for wines which are not successfully delivered.
4. Re-Shipping: Package(s) which are returned due to failed delivery and re-shipped will incur a re-shipping fee.
5. Redirected shipments: Once shipped, if you do need to change shipping destinations, we are happy to redirect your shipment if we are notified. A redirect fee and any additional shipping costs will be charged.
6. Tracking: Shipping tracking numbers are provided so you are aware of when a shipment is due to be delivered and can arrange for an adult of 21 years of age or older to be available to sign for the package.
7. Legal Restriction: Unfortunately, shipping regulations restrict us from shipping alcohol to PO Boxes or APO/FPO addresses.
8. Taxes & limitations: Individual state regulations for taxes and limits on shipping do apply.
8. Returned shipments: You are responsible for shipping, return and re-shipping costs.
9. Regulations for shipping wine vary by state. We comply with all regulations based on their individual shipping laws and limitations. Due to current state regulations, we regretfully cannot ship wine to all states.
10. Damaged shipments are insured. Please notify the winery immediately if your wine arrives damaged.
11. Wine is Sold Once Order is Processed: Once the order is processed the wine is considered purchased even if returned.
12. Heat & Weather Conditions: Because wine may be sensitive to the temperature variances that can occur during the summer months, we generally ship Monday through Wednesday. We may, at times, contact customers to consult on overnight shipping, or to hold the shipment back to help ensure the integrity of the wines.
13. Will Call: Orders can be placed via the website or phone and then picked up at the winery. Will Call orders must be picked up within 45 days of processing. After 45 days, your order will be shipped to you and shipping costs will be charged.
WINE CLUB POLICIES AND GUIDELINES
1. You must be 21 or older to be a member of our wine club. By registering for wine club membership, you are confirming you are 21 years of age or older.
2. Nefarious Cellars reserves the right to change your status as a club member at any time. We will not increase your club level without your consent.
3. Automatic Deliveries: Our wine club is an automatic delivery program. You agree to have the payment for your orders automatically charged on the account or card you have expressly provided Nefarious Cellars.
4. Limited Productions: The winery may substitute a different vintage of a wine (or a different wine of equal or greater value) if the specified vintage designated for that shipment is depleted during the pick-up/shipment time frame.
5. Return Policy: We stand behind every wine we make, and we want you to be completely satisfied with your purchase. If you are not satisfied with your order, please contact us within 30 days of receipt of your order and we will arrange for replacement (pending availability) or refund.
6. Member Details: Current contact, billing and shipping information must be provided by you in order for us to provide updates and make sure your wines get to you.
7. Loyalty Points: Loyalty points cannot be used for wine club allotments, tax, or shipping.
8. Collecting Your Club Allotment:
Pickup members understand and agree that your allotment will be available for pick-up on a scheduled release date. Wines will not be available before that release date.
Pickup members understand and agree that allotments and orders placed for pickup need to be collected within 45 days of the order charge date. If you have not picked up after 45 days, shipping, handling, and applicable taxes will be applied to your card on file. Your order will be shipped to your billing address on file. If your wine is returned after 3 attempts and we are unable to acquire a correct shipping address from you, a refund will be issued for your club shipment minus return fees and your membership will be terminated. If 2 consecutive orders are not picked up within the 45 days pick up period, we reserve the right to change your membership from pickup to ship for future allotments and general orders.
9. Membership will be ongoing until we receive a request in person or via email to terminate membership.
10. Minimum Commitment: We request a two shipment/allocation commitment - early termination fee may be imposed if you choose to leave the club before two shipments/allocations are completed.
11. Leaving the Program: You must notify the winery via email at hello@nefariouscellars.com at least 30 days prior to shipping with any changes or cancellations. Pick-up members should alert us by 10 days before charging if you are choosing to leave the wine club.
